Mars Finance reported on May 1st that the Guangzhou Internet Court recently held a public hearing for a case involving unfair competition related to AI intelligent agents. This case was listed as a model trial case for new types of unfair competition disputes involving AI intelligent agents by the court. A technology company and a system company jointly sued, accusing the defendant, a technology company, of developing and open-sourcing an AI chatbot without obtaining any permission from the two plaintiffs. The software, by calling the "accessibility service" permissions of the mobile operating system, automatically simulated human clicks and sending messages, effectively bypassing the plaintiffs' platform's technical management measures and disrupting the platform's normal operation. The defendant's official website also published "version spoofing" tutorials and false appeal guidelines to help users circumvent the platform's risk control. The plaintiffs sought 100,000 yuan in damages. The defendant claimed that the software was a free, open-source, non-profit project, that the automated operation was completed by independent third-party components, that the role scripts were uploaded by users themselves, and that the platform had connected to content review services and fulfilled its reasonable obligations. Before the trial, the court had ruled on injunctive relief—the defendant must immediately stop providing software downloads, delete the circumvention tutorials, delete the user data already obtained, and disconnect the links containing role scripts that violated the AI security risk control mechanism.
